Public Records Request

As a State agency, the Arizona Department of Financial Institutions (AZDFI) will process your public records request in accordance with Arizona statutes. Please be aware that the Federal Freedom of Information Act only governs requests made to federal agencies and, therefore, it does not apply to requests made to this agency.

The general principles of Arizona public records law are found in Title 39, Chapter 1, Arizona Revised Statutes, A.R.S.§ 39-102 through § 39-161.  For more information, see the Public Records Request Form.

The disclosure of the Department’s records is also controlled by A.R.S. § 6-129 and § 6-129.01. These two sections of State law make most of the Department’s records confidential and therefore not a public record. Department records that are confidential per A.R.S. will not be disclosed in response to the public records request.

Please review the specific sections of State law, in an effort to speed the completion of your request.  It is also very important to be as detailed in your request as possible.

Your written request also serves as a record of what you requested.

Public Records Fees
As permitted by A.R.S. § 39-121.01(D)(1), AZDFI charges a fee to cover the costs of reproduction and postage for hard copies of records being requested for non-commercial purposes.  Additional charges apply to public records requested for commercial purposes, see A.R.S. § 39-121.03.

The Department charges $0.25 per 8-1/2” x 11” page. Certified copies carry an additional charge of $2.00 per 8-1/2 x 11” page.

Copies furnished for a verified and specified commercial purpose are charged on a different basis. For those copies, the Department will charge:

  1. A portion of the Department's cost to obtain the records
  2. A reasonable fee for the cost of time, materials, equipment and personnel in producing the copies.
  3. The value of the copies on the commercial market as determined by the Department.

How do I request public records from AZDFI?

Requests MUST be submitted in writing, utilizing the agency’s Public Records Request Form. Requests will be accepted any time during regular business hours, Monday through Friday, 8:00 a.m. – 5:00 p.m.

Timing of Public Records Requests
AZDFI will make every effort to provide access to and/or copies of public records in a reasonable amount of time, generally within 5 to 10 business days. However, depending on the volume or age of the records requested, more time may be required. If a request is expected to be delayed more than 10 business days, AZDFI will notify the requester.  Delays may be caused by the amount of staff time necessary to handle large volumes of records or, if due to the age of the records, the records require off-site retrieval from the Arizona State Library Archives and Public Records facility.

Legal Review
In some cases records may be required to undergo a legal review prior to the release or review of materials by the public in order to avoid disclosure of information protected by statute.  Certain confidential personal or financial information may be redacted prior to distribution. In the event that the agency concludes that a request includes information protected from disclosure, the agency will provide a written response to the requester that explains why the information is protected from disclosure.
